Dmitry Kaysin, a Partner and Co-head of the Dispute Resolution practice at Asari Legal, and Stepan Rusanov, an Associate of the same practice, explain why enforcing Russian court judgments abroad is far from straightforward.
Unlike international arbitral awards, there is no universally recognised mechanism allowing court judgments rendered in one jurisdiction to be automatically recognised and enforced in another.
As a result, creditors who have successfully obtained a Russian court judgment against a foreign debtor often face the additional challenge of enforcing that judgment abroad. At the same time, the pool of assets held by foreign debtors in Russia continues to shrink, prompting an increasing number of creditors to seek recovery in foreign jurisdictions.
The authors examine why getting Russian court judgments recognised and enforced abroad remains highly jurisdiction-specific, with every case needing careful legal analysis and strategic planning.
