Dmitry Kaysin on international arbitration trends and the risks of “friendly” jurisdictions

Dmitry Kaysin, Partner at Asari Legal and Co-Head of the firm’s Dispute Resolution practice, shared his insights in an interview with the Dispute Resolution Club. He spoke about key trends, risks, and strategies for protecting the interests of Russian clients in international disputes.
“These days, you can’t rely on formal labels such as a ‘friendly jurisdiction.’ The issue is always more nuanced: who is deciding the case, what standards of impartiality are being used, what sanctions restrictions are in place, and what the real enforcement mechanisms are. Russian parties are increasingly testing new legal tools and approaches. In international disputes, sometimes it is the least obvious argument that ultimately proves decisive,” Dmitry Kaysin noted.
